Festival Etiquette

All guests checking into a room at either Breathless or Now Onyx Punta Cana (“AMResorts”) and attending Operation Monster Beach, May 26 – May 31, 2021 (“Festival”) agree that by doing so they accept and abide by the Festival Etiquette as described below. In addition, guests agree that the Festival Etiquette is part of the Terms & Conditions and Guest Contract provided to guests by MEGAMETAL, LLC and AMResorts, prior receipt of which guests acknowledge.

GUEST BEHAVIOR
MEGAMETAL, LLC  (“MEGAMETAL”) and AMResorts (“AMResorts”) have adopted a Zero Tolerance Policy and will not permit behavior by any Operation Monster Beach Guest (“Guests”) which negatively impacts the comfort, enjoyment, health, safety or well-being of other Guests, its performers and staff or the resort’s crew. In addition, violent, abusive or disrespectful behavior caused by the use of alcohol and/or an illegal substance shall not be tolerated. Guests agree to comply with this policy, and further acknowledge that MEGAMETAL and AMResorts reserve the right to refuse or discontinue admittance to any guest who, in MEGAMETAL or AMResort’s sole judgment, acts in a manner that adversely affects the festival experience of other Guests. This also includes but is not limited to: spousal abuse or violence directed at a family member. In all cases, MEGAMETAL and AMResorts shall not be liable for any damages, refund or other compensation, including travel costs or any other claim as a result of such behavior.

Guests acknowledge and understand that producing musical performances and appearances in a resort environment involves building a stage, installing lighting and sound equipment, and setting up other related equipment, including wire and electrical equipment. MEGAMETAL and AMResorts will use good faith efforts to do this in a safe manner. Nevertheless, Guests must stay away from and not touch any such materials or equipment, as improper use or interference with such materials or equipment can result in injuries to guest’s person, including, but not limited to, falls. In addition, you are solely responsible to avoid any contact whatsoever, whether purposeful, inadvertent or accidental with any production materials or equipment that may be present in the general vicinity of the staging areas around the resort. As set forth below, MEGAMETAL, AMResorts and the Released Parties shall have no responsibility or liability for any injuries you suffer as a result of your purposeful, inadvertent or accidental contact with such materials or equipment.

During the festival, Guests shall abide by and conduct him/herself in accordance with all rules, regulations and directions of MEGAMETAL and/or AMResorts, including, but not limited to, the following: during a performance, presentation, question and answer session, or other event, Guest shall not (i) attempt to move onto a stage on which any artist is performing, (ii) climb onto poles or other structures near the stage, (iii) throw anything onto or towards the stage, or (iv) do anything that may interfere with a performance or with the audience’s enjoyment of the performance. Guest agrees to immediately comply with the requests of MEGAMETAL and/or AMResorts security personnel.

SMOKING
Guest acknowledges and accepts the Smoking Policy as outlined by AMResorts. This includes acting in accordance with any posted signage or instruction given by MEGAMETAL and/or AMResorts Staff. In addition, Guests agree to follow the general guidelines as stated below:

Smoking is prohibited in the following areas: Indoors, in the pools, directly in front any of the stages as well as outdoor dining areas. This includes regular cigarettes, electronic cigarettes, cigars or pipes.

Smoking is permitted in the following areas (unless otherwise indicated): Guests may smoke on their balconies but NOT inside their rooms. Smoking inside your room may result in a cleaning charge added to your resort account. If cigarette burns on furniture, linens, towels or carpeting are detected; guests will be advised and charged for the damages. Electronic cigarettes cannot be used in public areas where there is a No Smoking policy in force. Additional smoking areas will be indicated with signage. Please abide by instructions from both resort and Operation Monster Beach Staff.

ILLEGAL SUBSTANCES
MEGAMETAL and AMResorts have a “Zero Tolerance” policy regarding the use, possession or distribution of any and all illegal controlled substances by Guests that are on resort grounds. Guests agree to comply with this policy and further acknowledge that any violation of this policy will result in the removal of the offender from the resort grounds. Guests acknowledge that it is MEGAMETAL and AMResort’s policy to report incidents of illegal activity or behavior to the appropriate law enforcement authorities for appropriate legal action. In such cases, MEGAMETAL and AMResorts shall not be liable for any damages, refund or other compensation, including travel costs or any other claim as a result of such behavior.

INTENTIONAL DAMAGE TO RESORT PROPERTY
MEGAMETAL and AMResorts have a “Zero Tolerance” policy regarding intentional damage to any item or property on the resort grounds or accidental damage to any item or property on the resort grounds as a result of general negligence, alcohol intoxication or the influence of an illegal substance. Guests causing any such damage agree to pay for identified damage prior to leaving the resort property. All Guests must agree to comply with this policy, and further acknowledge that any violation of this policy may result in the removal of the offender from the resort grounds. All Guests acknowledge that it is MEGAMETAL and AMResorts policy to report incidents of illegal activity or behavior to the appropriate law enforcement authorities for appropriate legal action. In such cases, MEGAMETAL and AMResorts shall not be liable for any damages, refund or other compensation, including travel costs or any other claim as a result of such behavior.

VIDEO, AUDIO & PHOTO POLICY
Photography with a fixed camera lens is permitted, however, professional cameras (video or still) or cameras with detachable lenses are not permitted. Out of respect for the performers, please refrain from flash photography during ALL Concerts. In addition, any and all videotaping or audio recording of concerts, performances and events is prohibited. Thank you for your cooperation.

THE RULES
During the Festival, including all performances and events, it is forbidden for Guests to:

(a) Try to access areas or sections during performances that are restricted to certain ticket holders unless your ticket permits such access (i.e., VIP areas, backstage areas, artists’ lounges); (b) climb onto ladders, tables, fences, lighting equipment (including towers and columns), sound equipment, or other equipment related to performances; (c) obstruct entrances and exits to the performance areas or fail to move out of an area if directed by security; (d) wear a disguise to avoid being recognized at a Festival event if Guest has been barred from attending such event; (e) wear clothing, hold up signs, harass other guests, make gestures, or otherwise do anything that in the reasonable discretion of MEGAMETAL, AMResorts or security personnel are xenophobic, offensive, pornographic, illegal, discriminatory, or racially motivated; (f) be under the influence of illegal drugs or substances and/or act in a way to reasonably cause security personnel to believe that you are in an impaired state (such as being inebriated); (g) disturb the enjoyment of the Festival by other Guests or compromise the safety of any person; (h) throw or shoot any object in a manner that may be harmful to others or that may interfere with the enjoyment of the Festival by another person; (i) refuse to follow the directions of security personnel; (j) litter in any fashion; and/or (k) steal any possessions of any person or entity.

In the event of a violation of the Festival Etiquette or the Terms & Conditions and/or Guest Contract by Guest during a performance and/or the Festival, Guest acknowledges that security personnel will act quickly to protect the artists, crew and other Guests, and to prevent Guest from disrupting the performance or creating safety issues for others. Such action may include prohibiting Guest from attending Festival performances and events, and/or removing Guest from the resort grounds, at Guest’s sole expense and responsibility.
